Terms of Use

1. Purpose
These Terms of Use (hereinafter "Terms") define the terms and conditions governing the use of the Wagly mobile application (hereinafter "the Application"), published by François Aubeut.
Wagly is a digital health record application for pets. It allows users to track vaccinations, treatments, symptoms, and the medical history of their animals, manage multiple pets within a single account, and share this information with trusted third parties (veterinarians, family members, pet sitters).
2. Acceptance of terms
Using the Application implies full and unreserved acceptance of these Terms. If you do not accept these Terms, you must not use the Application.
By creating an account or using the Application, you acknowledge that you have read these Terms and accept them without reservation.
3. Account creation and access
To use the Application, you must create an account by providing a valid email address and a password. You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.
You agree to:
- Provide accurate and up-to-date information when registering
- Maintain the security of your password
- Immediately notify François Aubeut of any unauthorized use of your account
- Not create multiple accounts for the same person
4. Use of the service
The Application allows you to:
- Create and manage health profiles for your pets
- Record vaccinations, treatments, symptoms, and veterinary visits
- Manage multiple pets within a single account, each with its own dedicated record
- Receive reminders for upcoming vaccinations and treatments
- Share a pet's health profile with trusted third parties
- Transfer ownership of a pet to another user of the Application
You agree to use the Application in accordance with its intended purpose and not to misuse it or use it in a fraudulent manner or in violation of applicable laws.
5. User responsibilities
The user is solely responsible for the information they enter into the Application. It is the user's responsibility to ensure the accuracy and currency of their pets' health data.
When using the sharing and transfer features, the user is responsible for choosing recipients and ensuring that sharing is carried out with trusted individuals.
6. Intellectual property
The Wagly Application, its design, features, source code, content, and brand are the exclusive property of François Aubeut and are protected by intellectual property laws.
Any reproduction, distribution, modification, or use of the Application or its elements, in whole or in part, without the prior written authorization of François Aubeut is strictly prohibited.
Data entered by the user remains their property. François Aubeut claims no ownership rights over user-generated content.
7. Data sharing and transfer between users
The Application offers two collaboration mechanisms:
- Sharing: You can share a pet's health profile with another user. That user will be able to view the pet's health information without becoming its owner. You can revoke this sharing at any time.
- Transfer: You can transfer ownership of a pet to another user. This action is permanent: the recipient becomes the new owner of the profile and all associated data.
François Aubeut is not responsible for any consequences arising from the sharing or transfer of data between users.
8. Limitation of liability
The Wagly Application does not constitute veterinary medical advice under any circumstances. The information recorded and displayed in the Application is provided for informational and personal organizational purposes only.
Wagly does not replace a veterinary consultation. If your pet has a health problem, you must consult a qualified veterinarian.
François Aubeut shall not be held liable for:
- The accuracy of information entered by users
- Decisions made by users based on information displayed in the Application
- Direct or indirect damages resulting from the use of or inability to use the Application
- Service interruptions, bugs, or data loss
- Consequences arising from the sharing or transfer of data between users
9. Modification of terms
François Aubeut reserves the right to modify these Terms at any time. Users will be notified of changes through a notification in the Application or by email.
Continued use of the Application after the publication of modifications constitutes acceptance of the new Terms. If you do not accept the new Terms, you must stop using the Application and delete your account.
10. Governing law
These Terms are governed by French law. Any dispute relating to the interpretation or performance of these Terms shall be submitted to the competent courts within the jurisdiction of François Aubeut's registered office.
11. Jurisdiction
In the event of a dispute relating to the use of the Application, the parties shall endeavor to reach an amicable solution. Failing that, the dispute shall be brought before the competent courts of Paris, France.
